Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a binding legal agreement between you ("User") and The Aacharya, operated under Trijal Enterprises ("we", "us", or "our"). By accessing, enrolling in, or using any of our services, you confirm your full understanding and acceptance of these Terms. If you do not agree with any clause herein, you must immediately discontinue use of our services and platform.

2. Scope of Services

The Aacharya delivers comprehensive academic, preparatory, and training services, including but not limited to:

• Online and offline instruction
• Talent exams and Olympiad preparation
• Business Development Associate (BDA) and teacher training
• Digital learning materials and assessments
• Student evaluation and performance tracking

We reserve the right to modify, enhance, suspend, or terminate any service at our discretion without prior notice, in the interest of service quality, academic integrity, or compliance.

3. User Obligations

• Provide accurate and complete information at the time of registration.
• Maintain confidentiality of account credentials and secure access.
• Use the platform ethically, lawfully, and without abuse.
• Refrain from unauthorized access, duplication, or sharing of course content.

Violations of these obligations may result in suspension or termination of access, legal action, and forfeiture of any associated fees.

4. Intellectual Property Rights

All digital content, study materials, logos, trademarks, training modules, and platform elements are the exclusive intellectual property of The Aacharya and Trijal Enterprises.

Unauthorized reproduction, resale, distribution, or public display is strictly prohibited and punishable under:

• The Copyright Act, 1957
• The Trademarks Act, 1999
• The Bharat Nyaya Sanhita, 2023

5. Payment & Fee Policy

• Fee payments must be made in full or through approved EMI channels before service activation.
• EMI plans are governed by partnered financial institutions. The Aacharya is not liable for any disputes between the User and financier.
• Defaulting on payments may result in suspension of services and legal recovery measures.
• Refunds are governed by our Refund Policy and are not guaranteed once service delivery has commenced.

6. Limitation of Liability

Unless required by law, the maximum liability of The Aacharya shall be limited to the total amount paid by the User over the preceding six (6) months.

We are not liable for indirect, incidental, or consequential damages, including but not limited to academic loss, data breach due to third-party negligence, or internet disruption on the user's end.

7. Conduct & Use Policy

Users must maintain decorum, respect, and professionalism across all interactions—live sessions, chats, forums, or events. Any instance of:

• Harassment (verbal, written, or digital)
• Cheating or academic dishonesty
• Threats or use of foul language
• Violation of community standards

will result in strict disciplinary action and legal escalation where appropriate.

8. Privacy & Data Protection

User data is collected and processed in accordance with the Information Technology Act, 2000 and applicable Indian data privacy regulations. We ensure:

• No sale of personal data to unauthorized parties
• Sharing only with partners under lawful grounds
• Transparency in data usage

9. Technical Requirements (for Online Users)

• Ensure stable internet and compatible devices
• The Aacharya is not liable for session disruptions due to user-side issues
• Unauthorized recording or replication of sessions is strictly prohibited

10. Policy Revisions

The Aacharya may amend these Terms periodically. Users will be informed via email or the website. Continued use after changes implies agreement to the updated Terms.

11. Governing Law and Jurisdiction

All disputes or claims shall be governed by Indian law, with jurisdiction limited to Varanasi District courts. Arbitration, if chosen, will be under the Arbitration and Conciliation Act, 1996.

12. Termination and Enforcement

We may suspend or terminate access without refund for:

• Violation of these Terms
• Legal non-compliance
• Abuse of resources or misconduct

Breaches may be reported to authorities where required.
